After consideration of the Draft Heritage Impact Assessment report, the committee further requires a Phase II Heritage Impact Assessment for consideration. Attention is drawn to the recommendation that, if the excavations of the development will exceed 1.5 m, a Desktop Palaeontological Impact Assessment will be required.
In terms of the Phase II Heritage Impact Assessment, the applicant is required to acquire the services of qualified individual(s) to assess both the study area as well as the ruins of the two buildings estimated to be over 60 years old in terms of Section 37 of the KwaZulu-Natal Amafa and Research Institute Act No. 05 of 2018.
The assessment should cover:
1.Identification of all heritage resources in the development area and its surroundings -50m. 2.Assessment of the impact of the development on such heritage. 3.Evaluation of the impact of the development on heritage resources relative to the sustainable social and economic benefits to be derived from the development. 4.Results of consultation with communities affected by the proposed development and other interested and affected parties regarding the impact of the development on heritage resources. 5.Consideration of alternatives if heritage resources are affected by the development Mitigation plans for any adverse effects during and after completion of the project. 6.Table of all heritage resources identified. This should show heritage resource type, description, location, significance, and reasons for this rating.With regards to public participation:1.Proof of public participation must be tabled.2.Method used to identify descendants must be recorded.3.List of stakeholders and descendants must be attached.Failure to comply with the requirements of the National Heritage Resources Act and the KwaZulu-Natal Amafa and Research Institute Act could lead to legal action being instituted against the applicant.
