The KZN Amafa and Research Institute (the Institute) reviewed the application on the 16 November 2021, and considered your application: The Committee resolved not to object to the development within the limits of the general stipulated conditions and mitigation measures.
STANDARD CONDITIONS
1. The KwaZulu-Natal Amafa and Research Institute should be contacted if any heritage objects are identified during earth-moving activities and all development should cease until further notice.
2. No structures older than sixty years or parts thereof are allowed to be demolished, altered, or extended without a permit from the KwaZulu-Natal Amafa and Research Institute.
3. Under no circumstances may any heritage material be destroyed, inundated, collected, or removed from the site unless under the direction of the KwaZulu-Natal and Amafa Research Institute and a heritage specialist.
4. Should any remains, that could potentially be human remains be found on-site, the South African Police Service (SAPS) should be contacted and the KwaZulu-Natal Amafa and Research Institute must be notified immediately. No SAPS official may disturb or exhume such remains, without the necessary permission from the KwaZulu-Natal Amafa and Research Institute. 5. No activities are allowed within 50m of a site that contains rock art.
6. Sources of all-natural materials (including topsoil, sands, natural gravels, crushed stone, asphalt, etc.) must be obtained in a sustainable manner and in compliance with the heritage and environmental (NEMA) legislation.

The permit application in respect of the above, was received on the 10 October 2022 reviewed by the KwaZulu-Natal Amafa and Research Institute (The Institute) on the 19 October 2022.

The committee noted that the applicant had submitted a copy of a notice for proof of public participation that had been inscribed in Isizulu, however the committee still requires evidence which illustrates, the date it was published, a poster which had been pinned on site for public interest to provide response, proof that locals had been notified based on the development.
The Committee had noted that a Basic Assessment Report, Heritage Impact Assessment, and public Participation had been provided to the Institute.
However, the public participation had been communicated in English format and not in the language which is used by the locals of the mentioned area for any comments eg. isiZulu.
The Committee requires a proof of public participation which has been conducted/communicated in isiZulu and allow the community to provide a correspondence to the development.
Written responses/requests for reconsideration of the application or consideration of new information must be loaded to the case on Sahris (email [email protected]) within 30 days of the date of this letter or any requirements/decisions contained herein will be considered final. Extensions of this time frame can be requested upon receipt of motivation. Required additional information or revised drawings must be submitted within six months from the date of this letter or the application will lapse and a new application will be required.
