REQUEST TO CONDONE ILLEGAL WORK AT 185 BURGER STREET, PIETERMARITZBURG, 3201
Please be advised as follows:
The owner requested that the KZN Amafa & Research Institute must change the client's proposal and to allow them to remove the deck in front of 185 Burger Street. It was explained that the owner did not want to go ahead with adding a deck to the coffee shop. However, since the category of analysis for illegal work, is the erf, as well as the main house on 185 Burger Street; and to allow for the HOC-members to analyse whether any illegal alterations and additions already took place after the building turned 60 years, the owner will still have to:
a) load a full set of coloured and numbered plans, including elevations, site plan, floor plans and door as well as window schedules to the SAHRIS website, it will be perused as soon as possible for decision.
b) The owner must now complete Form A, for any new work that must be done on the property, for instance removal of the deck, because legislation inform us that any alteration and/addition or changes on the specific Erf or Address must go through the same proccess. Thank you for recognising the value of the Cape Dutch Revival facade, we appreciate that you want to remove it. But the owner must still load a full set of plans, upload From A and pay R800 for application A.
Written responses/requests for review of the decision taken must be received via email to [email protected] within 30 days of the date of this letter or any decision contained herein will be considered final.
Extensions of 30 days may be requested; if additional information is needed or revised drawings, these documents must be submitted within 6 months of the date of this letter or the application will lapse and a new application and fee to be paid, is necessary.
If public participation is necessary, the applicant will be notified of the level of public participation necessary: For development and demolition applications the neighbours, ward councillor and heritage societies must be contacted. Owners and residents within 100m must be consulted for demolition applications. All documents submitted is retained for record purposes and interested and affected parties may apply to view the applications.
THIS LETTER DOES NOT CONSTITUTE FORMAL APPROVAL OF THE PROPOSAL SUBMITTED TO THE INSTITUTE, UNAUTHORISED WORK CARRIED OUT ON THE ABOVE SITE WILL BE IN CONTRAVENTION OF THE KWA-ZULU NATAL AMAFA AND RESEARCH INSTITUTE ACT (5 of 2018)
