Final Comment
The SAHRA Development Applications Unit (DAU) notes the submission of the Letter of Recommendation for Exemption. SAHRA accepts the reasoning’s set out in the Letter of Recommendation for Exemption stating that an HIA is not required on the following conditions:
38(4)a – The SAHRA Development Applications Unit (DAU) has no objections to the proposed development;
38(4)b – The mitigation measures recommended by the heritage specialist are supported and must be adhered to.
The following additional comments include:
38(4)c(i) – If any evidence of submerged prehistory, maritime archaeology or palaeontological sites are encountered are found during the proposed activities, work must cease and the SAHRA DAU (Natasha Higgitt 021 202 8660 or Briege Williams 021 202 8688) must be alerted as per section 35(3) of the NHRA. Non-compliance with section of the NHRA is an offence in terms of section 51(1)e of the NHRA and item 5 of the Schedule;

This comment must be forwarded to the competent authority;
The decision regarding the EA Application must be communicated to SAHRA and uploaded to the SAHRIS Case application.
