REFERRAL LETTER

The permit application in respect of the above, received and reviewed on 11 December 2024 by the KwaZulu-Natal Amafa and Research Institute (The Institute) refers.  

Please be advised as follows:

  • The application was discussed however, the committee noted that the previous application for the demolition of the structures on this property had been refused due to the sensitivity of the heritage resources within the immediate vicinity of the site.
  • It was noted that on inspection of another property in 2023 in the area that the structures on the site had been demolished without a permit having been obtained.
  • It was noted that this application was aligned to those for 322 Lilian Ngoyi Road and 22 Peace Avenue, a listed building and, as the proposed development would cover 3 or more sites, a Form J application was required.
  • No proposal for the replacement structure had been submitted and the public consultation process was incomplete.

FURTHER REQUIREMENTS:

The application was referred for further requirements where;

  • Form I required for the unauthorized demolition of the structures on site. 
  • The HOC members will conduct a site inspection. 
  • A Form J (s41) application for the development of over 3 sites was required.
  • Drawings for the replacement building were required.
  • Further Public Participation was required – the Ward Councillor is to be requested to hold a community meeting and the SAIA-KZN Heritage Committee must be consulted.
  • The public consultation must allow 30 days for comment, excluding the period from 15 December 2024 to 15 January 2025.

Written responses/requests for reconsideration of the application or consideration of new information must be loaded to the case on SAHRIS (email [email protected]) within 30 days of the date of this letter or any requirements/decisions contained herein will be considered final.  Extensions of this time frame can be requested upon receipt of motivation.

Required additional information or revised drawings must be submitted within six months from the date of this letter or the application will lapse and a new application will be required.

THIS LETTER DOES NOT CONSTITUTE FORMAL APPROVAL OF THE PROPOSAL SUBMITTED TO THE INSTITUTE.  UNAUTHORISED WORK CARRIED OUT ON THE ABOVE SITE WILL BE IN CONTRAVENTION OF THE KWAZULU-NATAL AMAFA AND RESEARCH INSTITUTE ACT (5 of 2018).
