REFERRAL LETTER
The application in respect of the above, received and reviewed by the KwaZulu-Natal Amafa and Research Institute (The Institute) on the 05 March 2025 refers.
Please be advised as follows:
- The committee noted that a BAR and AIA had been submitted
- The reports identified 59 graves that were in close proximity to the proposed development footprint, 2 of which were within 50m from the proposed mine.
- The community had been consulted and most graves identified, and the process of identification is ongoing.
- Exhumation of some of the affected graves had been agreed to and was proposed for those within 50m radius.
- Ruined structures had been found but these were under 60 years of age.
DECISION
- The committee resolved not to object to the proposed mining activity on confirmation that the affected graves are less than 60 years of age, and within the limits of the general stipulated conditions and mitigation measures.
- Permit applications must be submitted for the exhumation of any graves that are over 60 years of age.
Written responses/requests for reconsideration of the application or consideration of new information must be loaded to the case on Sahris (email [email protected]) within 30 days of the date of this letter or any requirements/decisions contained herein will be considered final. Extensions of this time frame can be requested upon receipt of motivation.
Required additional information or revised drawings must be submitted within six months from the date of this letter or the application will lapse and a new application will be required.
THIS LETTER DOES NOT CONSTITUTE FORMAL APPROVAL OF THE PROPOSAL SUBMITTED TO THE INSTITUTE. UNAUTHORISED WORK CARRIED OUT ON THE ABOVE SITE WILL BE IN CONTRAVENTION OF THE KWAZULU-NATAL AMAFA AND RESEARCH INSTITUTE ACT (5 of 2018).
